Summary: | The march of modernisation and the introduction of products of greater sophistication and complexity in the marketplace have also seen the rising trend of damage, injury and adverse consequences suffered by consumers as a result of product failure, shoddy workmanship or defective design. Product liability law seeks to provide redress for damage suffered by the victims of defective products. The body of law encompasses a composite mix of various statutes and common law principles.
Over the years, product liability law has undergone rapid changes and become increasingly important in the contemporary legal, social and economic development of many countries in different parts of the world including Malaysia. The Malaysian law of product liability is succinctly discussed in this book. The applicable statutes like the Contracts Act 1950, the Sale of Goods Act 1957 and the Consumer Protection Act 1987 as well as case law are analysed and explained to provide a helpful guide to this area of law.
